  • Pennsylvania Association for Retarded Children (PARC) v. Commonwealth of Pennsylvania

    13 school districts who had students with mental retardation, were not receiving public education which violated the 14th Amendment. The children were considered to be a burden especially to be integrated in the classroom environment.
    The Plaintiffs said that the students were being excluded from public schools because of their disabilities (Wiggins & Willson, 2013)
  • Final Court Ruling

    The court ruled that every student who are considered to be mentally retarded or disabled, are to receive a free and proper education. With the child's education tailored to what their special needs are and what their goals are in their IEP.
  • Mills v. Board of Education

    The district of Colombia failed to provide a education that supported students who are considered to be disabled. Also there were no teachers who were properly trained to teach these students. The students would be expelled, suspended, and excluded fro school because of their disabilities.
  • Court Ruling

    The court ruled that the District of Columbia can not deny any students an education because of their disability. They also need to provide an education plan, for their treatment and care of children who are three to twenty-one years old (www.kidstogether.org, 1972).
  • Honig v. Doe

    John Doe had a disability which he had a difficult time controlling his impulses. He was getting teased by another student at school and he attacked and pushed the other student out of the school window. John was suspended pending expulsion.
  • Court Ruling

    The court granted Handicapped students request and issued a permanent injunction, stating that prevents the school district from indefinitely suspending a student, because of their disability-related issues. The School district filed an appeal, so then the Supreme Court agreed and put the "Stay Put" act which prohibits state and schools from excluding disabled students even if hey are disruptive or have a dangerous conduct because of their disability (Honig v. Doe, n.d.).
  • My choice

    I chose to use this historical court case, because the students in 13 different districts in Pennsylvania were not getting the proper education. The Districts believed that the students were a burden because of their disabilities. No student is a burden because of their disabilities!
  • My Reason Why

    I chose to do this court case, because seven students were being suspended, expelled and excluded from public school because of their disabilities. Every child who are disabled should have a plan for their education so they can get a proper education.
  • My Thoughts

    John Doe's disability or part of it was, he had a difficulty controlling his impulses so if he got mad he would lash out and not be able to help what he is doing. I feel Like what John did was wrong, however I also think that he was right in a way, because the other child was teasing him.
