Special Education Landmark Court Cases

  • PARC v. Commonwealth of Pennsylvania

This case ensured that all students, regardless of their disability, will be provided with FAPE, Free Appropriate Public Education. Also, this case supports the needs of children with disabilities because it was the precedent case that any discrimination towards individuals with disabilities is not tolerable nor ethical.

  • Doe v. Koger

This case was monumental for children with disabilities because it has to be determined first if a child's behavior is caused by their disability before they can be expelled or a disciplinary action can be taken. If it has been decided that their behavior is due to their disability, it is up to the school to find a more restrictive environment for the child.

  • Board of Education of Hendrick Hudson Central School District v. Rowley

The outcome of this case is that even though all students are to be provided with FAPE, Free Appropriate Public Education, it is not the school district's responsibility to provide every student that has a disability, with every special service available.
